India and Germany signed the DTAA in 1996. It means you don't pay tax twice on the same income. Here are the rules that matter most for Desis in Germany:
NRE FD interest is exempt from Indian tax. In Germany, you must declare it under Anlage KAP. After your €1,000 Sparerpauschbetrag, you pay 25% Abgeltungsteuer. Use DTAA Form 10F to prove you're tax-resident in Germany.
Capital gains and dividends from Indian mutual funds must be declared in Germany (Anlage AUS of your Steuererklärung). Any TDS withheld in India can be credited against your German tax — so you only pay the difference, not double.
Indian rental income is taxed in India (30% TDS for NRI). Under DTAA, you declare it in Germany and get credit for Indian tax paid. Effective German rate applies on the net. Keep receipts and TDS certificates.
If you spend less than 182 days in India in a financial year (April–March), you are an NRI for Indian tax purposes. Your German salary is NOT taxed in India. Only India-sourced income (FD interest, rent, capital gains) is taxable there.
Germany taxes worldwide income. If you are tax-resident in Germany (you live here), you must declare ALL income globally — Indian FD interest, dividends, rental income — in your annual Steuererklärung (tax return). Failure can result in back-taxes + interest.
NRE FD interest is tax-free in India. You pay German tax on it, but you already pay German tax on everything anyway. So NRE FDs effectively give you Indian interest rates with only German taxation — no double tax at all.
